The actual problem is, the Congress. Lawmakers are the problem. They know everything what is going on. They know that not just desi companies but even larger companies take advantage of the vulnerable part of the society - the immigrants. Inspite of having all the information, the lawmakers deliberately did not add necessary protections for immigrants. And, even if the system becomes more efficient, people who enjoy the gutter will continue to live in the gutter. No laws or protections can help folks like you. Every now and then, just come to forum like these and rant once in a while. That's what you will do. The fact is you do not need better treatment or benefits. You need better therapy to tell you that you can come out of the gutter.

We should be fighting against these injustices rather than fighting among ourselves.

I think if you have long term plans in India this fall and probably more appreciation of Rupee will make US less attractive. This 5-6% fall has shaved off my appraisal in a way :)

You have a little tricky situation at hand, but you'll be okay if what you wrote is true - Your employer will not revoke your pending I-140. Not only that, they have to be nice enough to respond to any RFEs that come for your case. they can state that the imimgration application they filed for you is for a future position.
Also, USCIS has a guideline about these cases. They are supposed to see if your I-140 was 'approvable' if it had been adjudicated within 180 days or before you leave the company, which I think it should be.
I understand there are some anxious days ahead for you, but If I had to bet, I would bet on successful result of your case in the end :).
Just make sure that your old employer doesn't revoke your I-140

Guys,
Thats what my Question is......how i am gonna prove it i paid 3k for my H1. They are deducting 500 (for my H1) everymonth from my paycheck in the name of CASH ADVANCE DEDUCTION.
I really want to teach them a lesson....so that they stop messing many vulenerable people like me who go to them every year. Could somebody tell me how i am gonna complain DOL in new jersey about this company and does DOL really takes any action.
Greencard is not i am much looking for......i am planning to go back to india after 2-3 years.

Hi everyone.
I was part of the San Jose rally .. where there were about 300 odd people.
My neighbors had been to the immigration rally in Washington(flew from San Jose) and they said that there were about 1000 people there.
I have been following the immigration issues for sometime .. and I'm not very convinced that such small numbers can make the difference.
Silicon Valley has maybe a 100,000 Indian engineers or more. Add families .. and a much higher number. Add Chinese and European immigrants .. and you have all of Silicon valley :)
We should hold a huge rally say in the campus of some company like Cisco .. or Google(who are immigrant friendly) on a work day .. say Friday lunch time .. and have everyone attend.
Being in Cisco .. you can pretty much get all their employees to attend... which is substantial.
Also have industry people talking in favor of better immigration policies.
(we could hold it in some other company or a common area .. anything works)
Unless we can have a substantial number of folks say 10,000 or more .. I don't honestly see too much of a point.
Even if IV collects a few million dollars .. and lobbies .. it will never have the impact of 10000 people protesting.
We need to see if we can have similar rallies ever month in major hubs like New York, Washington, Seattle, Houston.
Unless we have s sustained campaign and we have the numbers .. I personally do not see things really changing.
I see people being optimistic about 300 folks in San Jose rally and 1000 in Washington. But having been to the rally in San Jose I don't see how 3 times that number in Washington is going to cut it. (Read Logiclife's post ... but we still need the numbers !!)
I'm not being a pessimist .. appreciate all the efforts that IV core undertakes .. but am totally unconvinced of major immigration changes. Looking at something like CIR being struck down .. after being on television for long and being debated .. I think we should get real.

I have lived in Nevada before. I think in that state and many other western states (where guns laws are more liberal) you have to have passport, I-94 and utility bills proving you have lived in NV for 6 months. That's it. You don't need hunting license to get a gun license.
Here is the biggest irony:
IN order to own a gun, FBI needs only 2 days to check your background.
IN order to get 485 approved, FBI takes months or years to do a background check.
I guess green-card is a more lethal weapon than a handgun.
There are federal firearm laws and then there are local (state) firearm laws.
State laws can be more restrictive than federal laws (atleast when it comes to firearms), but never less restrictive.
Federal law states that non-immigrants (even AOS) are prohibited from owning firearms unless they fall under one of 4 exceptions, the easiest one being the hunting license exception.
If you have a valid hunting license, issued anywhere in the United States (you could live in NV and have a hunting license from NY) you are okay on the Federal level.
After you have met that exception, you have to check and see if your state has additional restrictions.
Some states don't discriminate between citizens/non citizens when it comes to firearms, some do.
e.g. in MA, non-citizens (even GC holders) are only allowed to own non large capacity rifles and shotguns, which means no handguns, and no large capacity rifles (ARs, AKs and the like).
Logiclife, yes, there are some cases where a non-immigrant accidentally manages to bypass the hunting license requirement. This can happen in states which issue their own non-citizen permits. The applicant gets the 'non-citizen' permit and thinks that he/she has done their part and is now okay to purchase/possess a firearm. This is somewhat of a loophole that every non-immigrant buyer should be wary of and absolutely avoid. Sometimes the NICS background people can also approve the transaction without realizing the non-immigrant situation, but that doesn't mean its okay, I have confirmed this with the ATF on the phone.
Getting a hunting license is not difficult though, passing a simple hunter safety course is all that is required.
That being said, I am very pleased to find responsible and safe firearms enthusiasts on this forum.

In our pre-trial conference, we don't have chance to say any words in our case. Judge only asked my wife if she need no-contact or peaceful contact with me. My wife said no for either. But that DA still insist peaceful contact. Finally judge set peaceful contact for us.
SO far my wife's police statement is only words from her. Definitely my wife support me, she even asked my attorney if she plead guilty to peace disturbance, is that possible to dismiss my battery charge. Sure I don't want to risk her for any bad record. I will say we are in good marriage although we play around all the time. (Definitely we much careful since that terrible event)
Is that useful we find some witness, my wife's colleague and friends to demonstrate we are in good relationship?
