Not excatly. eb3_2004 has posted the link of INA. You will find more interesting things if you read through it.
Non-descrimination rule is clearly spelled out in Section 202 (a). I assume this rule should be generally applied to all applicants, no matter which categories they are falling, unless other rules specifically provided in paragraph (2) and in sections 101(a)(27) , 201(b)(2)(A)(i) , and 203.
INA does not say to spillover unused visas first to EB2 then EB3. I assume USCIS and Department of State should treat each EB applicants equally (based on their priority dates, not based on EB categories) in according to INA act.
It is likely the misinterpretation violates the law. We need some one which more professional knowledge to read through it. Can some core member help?

I am on H1/EAD and own a home. Lenders don't deny you a loan solely based on your visa status. Some think its too risky to own a home before getting a green card. I think this is a personal choice you make based on your comfort level. IMHO, we should keep the home ownership out of this. If we include things that are simply not true, it will only make our letter(s) less credible.

However, I have heard of one case right now because of the subprime mess where the lender did not go ahead with the loan because of the risk. i am not saying there arent any banks out there where you wont get a loan, but some banks are switching gears and making really safe loans compared to their risk taking ability a few yrs back.

EB1 is the most imp for US, followed by EB2, followed by EB3?
Why should USCIS follow the approach of oldest priority first? without any regards to the EB categories?
EB categories were created for a reason, doesn't matter how smart you are. If you are in lower skill category your wait is bound to be more. I don't see anything wrong in that.
If EB1 is current and EB2 takes 4-5 years you can't just start crying. Similarly if EB2 takes 2 years and Eb3 takes 7-8 years you can't panic. Stop being a cry baby and start respecting the inter EB level priority.

This is just a message to 2005/2006/2007 PD guys. Please don't think that some miracle will happen and dates will be current soon, it will take its own time. Mostly for EB2 & EB3June 2006- June 2007 guys, it will be like a lottery if the PD becomes current somewhere in 2007 Oct-Nov time. Right??

In Debt-based economy (such as US primarily) Bank (or lender) has obligation to verify if the loaner is capable of paying the monthly mortgage. Especially when they are giving 0% down and false documentation (HIGH RISK LOANERS) they assess that mortgage highest risk.
Now, there are financial institutions who will combine the all these mortgages into big pile and spin-off into mortage-backed securities. There are agencies rating these into A+, A++, A+++, B+ blah blah...
Watch PBS network for this.
These securities are bought out by some other companies (may be good companies who never would have loaned these HIGH RISK LOANERS).
Now this goes on goes on and crosses country boundaries in the current global economical CHAIN.
Everyone thought that (blindsighted) Mortgage prices are going to go up no matter what. But if you are not creating jobs which will drive internal growth of these economies how are you going to get more DEMAND?
Hence, when US market goes down, Japan suffers, China suffers and India too (software exports cutback etc).
So, the level responsibility and ethical conduct applies to EVERYBODY in this chain.
We are all part of it directly or indirectly weather we say yes or no. The naysayers do not know complete picture, I assume. Even I do not know complete picture yet.
However, common sense will taught you to be FAIR. So, anytime you say, I want to MAKE MONEY there is a catch of MIGHT LOOSE MONEY. Take anything. Even currency note says, IN GOD WE TRUST.

I feel we should have some banners up in different Indian stores, specially targeting some selfish EAD holders, who already feel they got their green cards irrespective of the current visa bulletin
1. Setting up banners will not only attract new members, but will make these EAD holders think from a rational perspective.
2.Also IV administration should send out a personal email to all it members, informing them about the importance of coming together, this way the EAD members who have stopped coming to IV will get the message.
3. We should contact the Indian newspaper editors, to print about our rally on March1st 2009, I believe more awareness we spread a better result we get.

my 485 was filed during Aug 2007 , i had EAD as well that i never used.(EB3)
i joined another firm and started off fresh using old PD, and EB2, which got ported
I had 2 RFE on my prior 485 FOR medicals and EVL. that i answered ( company didnt had issues as long as i was paying for it)
now How do i get my prior 485 to be merged, since its not an easy case, my new firm isnt willing to do so, can i raise SR/IO and try it? is it worth it

I have read on USCIS web site that it is a quarterly report, this strange report do not have a date on it saying when it was generated. If it is a quarterly report I dont understand why they ran it in the middle of a quarter? This report should be run at the end of the quarter. Not in 1600AD what USCIS considers to be 2009.

I had called up USCIS and they have transferred the call to second level IO, as my application is 90 days old. They donot find the information yet. (My employer says, they clubbed the applications in one fedex box and sent it. Got the list of FedEx tracking number, one tracking number has 4 pounds, so guessing he would have put my application in it. ) The IO says, I have to take the fedex tracking number printout as proof and send them by postal mail, so that they can track back with their computer systems. Do now know when I will receive RNs. May be I have to maintain another tracking number for this inquiry mail also.

If the job required a EB2 or EB3 but EB3 was filed earlier. Is that possible?
for the same job position it should not be possible. When the employer filed in EB3, the employer must have provided all documentation necessary to justify the EB3 status. If now, the employer has to go back and indicate that the job requirement matched EB2 status, then that indicates something was not done right during the earlier application. That could right away trigger a RFE.

Yes true but passing of Vise arecapture bill is like waiting for 'Kumbhkaran' to wake up, they've been sleeping for 4-5 years what is the gurantee that they'll not sleep for another 5 years on the immigration bills ? Also, how is the spillover going to be distributed among EB3? First EB3 ROW and then EB3 C/I as in the old system?
Personally, I think the visa recapture bill would help things quite a bit.

How to Contact USCIS and FBI to Check Case Status
1. USCIS Online Status Check
With a case number, you will be able to see the current status and the last updated date (LUD).
You can set up a profile, including user name and password, and create a portfolio that includes all your immigration cases. Then log on and see the latest updates on all of them, such as I-485, I-140, AP, EAD, spouse’s cases, etc. Another useful feature for this option is that you can set up an email alert to receive automatic updates. Note that if there is a LUD change, but the message remains the same, you will not receive an alert.
2. Call National Customer Service at (800) 375 - 5283
Unfortunately, the customer service representatives don't know much more than what the online system shows. So it is not very helpful in most cases. However, on the phone you may place an inquiry with the service center that is processing your case.
3. Place a USCIS Inquiry
If your case is 30 days outside of the current processing dates, you can call customer service ( 800-375-5283) and place an inquiry. The representative will send an online message to the service center, which then mails you a letter in a few weeks to explain why your case hasn't been adjudicated. Recently, the answer is usually "your case is pending security check" or "your case is still within our processing dates."
4. Talk to a Service Center Representative Directly
Still by calling 800-375-5283, you will hear a long list of options. Choosing the right options will lead you to the service center that is processing your case. Because each case is unique, you need to listen to the options carefully and choose the ones that fit your case.
Even if you reach the center, you may be automatically transferred back to general customer service. But sometimes your call will be picked up at the service center. Explain your situation briefly, be polite but persistent, and ask about your case status. They do know a lot more details about your case, but have been instructed not to reveal much information, especially regarding background checks and FBI name checks.
5. Set up an Infopass Appointment
An infopass allows you to talk to an immigration officer directly, who has access to more information than the online system. So this is a better option to check on case status. An officer would be able to tell you whether your FBI name check has been cleared. This information alone is worth a trip for many.
6. Place a Congressional Inquiry
Writing to your senators and/or house representatives is another good option for people whose cases have been pending for a long time. Go to these websites:
and find the congressional representatives for your region. Thank you very much for your update. Went to the Infopass today and as per the IO came to know that my case is in adjudication review and will get the interview. I don't know how much ombudsman will be helpful, but will try all options. My labour was approved in 2 months and I-140 in 18 days but it seems I485 is sturck for ever :mad:

Thank you very much for your update. Went to the Infopass today and as per the IO came to know that my case is in adjudication review and will get the interview. I don't know how much ombudsman will be helpful, but will try all options. My labour was approved in 2 months and I-140 in 18 days but it seems I485 is sturck for ever :mad:

for whom the visa numbers would be available - FACT!!
FRIDAY - Allowed doctors from "any area" - FACT!!
MONDAY - We won't accept any applications?????? ----RUMOUR
they don't add up
I was thinking on the same line. Why to wait at the last moment and that too when today they allowed the medical examinations to be done outside the local area. I guess, time to chill out, have some beer (i'm already having) and worry on monday. We anyway can't do anything about it on sat-sun.

So attack on L1 is on the way.
What about another plan to attack F1?
You are NOT supposed to have immigration intent when you apply F1. So what about targeting all those F1 now, since it is very obvious that they didnt come here just to study and go back. So lets smoke them out based on their "fraud intentions" at the time of F1 application.
After that lets attack the H1 landers. Many of them landed in H1 with body shoppers, and later changed to some big american company. Lets find some thing or other against these body shoppers, and all those H1 came with these body shoppers should go back (even though they are with some other company).
Ok. what is left.......... lets find out something bad about everybody else, except me.
