actually, lets make another category 3.c. people who have shifted jobs after ead using AC21 and now want to or already have started a company for side business (that may be in the labor/perm cert job description or outside)...

So, I am 3.c. and so is perhaps matreen... after digesting my conversation with the lawyer for two three days now, i am feeling that it might be worth taking the risk of doing a side business. after all, we are not doing anything that is uncivil or criminal... just trying to boost our incomes and perhaps contribute to an industry or something like that... that noble intention could be viewed as an exclusive intention in relation to the intention to continue permanent employment with the new GC sponsoring employer... what do you guys think?

If you are on 3a, you have neither used AC21 nor have you left your full time job (FT job that aligns with your LC). On EAD, you can do any number of jobs (ex: you can even work 2 part time jobs totally unrelated to your LC requirements ofcourse as long as you continue to be with your GC employer). Using this rationale, you should be fine starting a business and making profit in the part time.

In fact even those who were in 3 b were able to get their GC after an interview (Search for posts by the user "unitednations"). But, it's risky and best avoided.

Personally, I want to get into 3 a, but my 140 is still pending. I plan to approach my company to switch me to EAD as soon as my 140 gets approved.

PS: This is not legal advice. Please contact your attorney and do more research before taking any steps further.

I ran across this article in one of the websites and read through all the links. I think, there is a strong message in this case, something I have personally faced in the past and do still face at at a smaller level. Though it is not an attempt to help raise money for her. Do please go through those news articles.
Moderators can delete this thread if it is not relevant.

[B]Neelima is a native of AndhraPradesh, and most of you know about her racial discrimination and harassment law suit and her fight against injustice (below are the links for details) in US. On March 26 her case is going to trial in Dallas Federal Court. The legal battle has changed their life completely – financially and emotionally. The harassments, threats, slurs and retaliation that she faced at Caremark left her with no option but to file a discrimination lawsuit against the company. Because of the extreme harassment, she was diagnosed with post traumatic stress disorder resulting in her husband quitting his job to take care of her and their two small kids. Their American dream was shattered, they exhausted their savings, sold their house and car just to bear expenses and survive. With no health insurance her medical bills piled up as a result of the hospitalizations, expensive medications and treatments. Despite all these setbacks, she intends to keep the battle alive and keep fighting for a just cause.

Her fight is not against America or Americans, it’s against injustice. She is fighting for the dignity and the rights of every one of us.

He means July 2008, i.e. the last quarter of the year when USCIS feels the need to use up the 140,000 visas.

If that happens again it will be sick. But it is an easy way for USCIS to avoid processing applications in priority date order. Just have DoS (dept of state) make the bulletin move forward or make current for a brief time, then they can approve applications in any order convenient for them. Then move it back again so no one can send them new applications.

Think I'm kidding, that's what the 2007 July mess was caused by!

Guys who r going 2 get married after August 17th and have their PD after Dec 2006 and have atleast 2 years of H1-B period left!!Y apply 485 now and wait for atleast 3 to 4 years to apply your spouses. The way I see it you can only apply your spouse's 485 when the PD becomes current again!!Instead y not wait 3 to 4 years and apply simultaneously!!Atleast give the guys who have older PD's a break!!

Yes, my Bachelor and Master's are in same/related discipline. I think you can use any education evaluator but make sure that are aware of Indian Education System. We have responded to the RFE. I will post the outcome for the benefit for all.

    Thank you very much!

Exactly what happens when thousands of people contact senators instead of one fax from one organization with one point of contact just so that if some one actually calls back from the senator’s office we at least have some one who could explain the situation in a way that makes sense?

There is another side to that coin, Senators will not be swayed on an issue unless it directly affects a constituent of theirs. AILA has fax and mail campaigns and so do anti-immigrant organizations such as NumbersUSA who according to their organization last week in only 3 days claim to have sent 120K faxes! IMHO one fax will not cut it, a hard copy letter with every single member's name signed to it would be great but picture the logistics with only 2 days to act. I again refer to AILA, AILA has sent letters (see my earlier post referring to the links) but also urges the public and pro-immigrant groups to contact congress enmasse with content that they provide. As for the person who couldn't articulate the issues, that is indeed unfortunate as one in a worst case scenario can always give their personal story, be it retrogression, BECs, H1 cap, H4 inability to work etc etc or if they need to gather their talking points request an appointment to discuss the issue.

In my opinion if you choose to use EAD, I think you will be very much fine with this route but with H1 transfer it will be tricky. You may have to go through 2 H1 transfer to come up clean legally. First H1 transfer to new employer and second H1 transfer to old employer again As you did not work for old employer for one yerar and hence no pay stubs and hence technically H1 dies there and so if old employer is willing "to hire again after one year" your old employer should file new h1 transfer and then you can come clean.

And during all this juggling make 2 things sure.

    - You do not get promotion
    - You do not get more than reasonable (10-20%) increment in the salary (The slary which was mentioned in your labor application)

Again before juggling consult the lawyer first.
I will be on EAD for the new job..and the LOA is vacation without pay. My salary is already 30% more than the one mentioned in labor but no promotions..new job has actually lower salary and job description similar.

If i do ger rfe for evl with me in new job then I hope salary doesnot become an issue

The text originally Posted by GoneSouth was great and we need more like this one. I feel that the stories should appeal more to the heart and than being heavy on technicalities. People would respond more when they see american values being abused than when they read how the green card process actually works. I wish I had the writing skills that many of the members have, but these are some of the things i would write about if I could write one.

    1. The lack of freedom for legal immigrants. The country that values freedom so much and went to war for it would certainly like to address the issue for its own future citizens/residents.

    2. The desperation and frustration of the highly skilled and educated immigrants.

    3. The affects of the immigration process on the spouses of immigrants (boredom, anxiety, lack of financial independence, waste of their degrees etc.) and affects on marriages.

    4. America no longer being a magnet for the bright and the smartest. (only one IIT ian graduate supposedly took up a job in the US, i read somewhere). How the future Vinod Khosla-s and Pramod Haque's are rotting in the current immigration system.

    5. Link the current EB immigration system to slavery.

    6. A picture speaks a thousand words, so maybe some photographs or comics might help (like chained IT workers, spouses whose degrees are wasted etc.)

    7. I see a lot of nice quotes in some of the texts. Maybe it is nice to collect some of the nice quotes and publish them somewhere.

Maybe its best to use our contacts in our home countries to get some stories printed in leading newspapers/publications. In this flat world, the stories would float around and reach a wider audience.

    my few cents.

    regards,
    -ks.

With all due respect, the probelem I have with volunteers is that I don't think amtures can pull a job this big, you've got to have profesionals, somethng like a compain maneger.

I admire the courage of your guys, and think the goal is fantastic. But the way it goes, I don't see how it can be achieved.

I've learned a great deal about immigration from the forum here. I very much appreciate it. I try to give back by answering questions others may have. I think IV has been doing a great job serving as that capacity.

But you guys want do something bigger. Well, you have faith in it, I don't, at least not now, neither many others. Maybe that is why you are still asking for money and volunteers.

IV was started by a few dedicated members, it has grown since then. It will continue to grow. As it grows and get more funding, IV can hire someone professional to do the things you say. However, you have to start somewhere. Can't expect to have paid professional managers first, before we even have the funding, and then look for funding to do the things it does.

And IV is more than a website. We want to build a strong grass roots movement by strengthening the state chapters. There is more than just lobbying that needs to be done.

As I was reading the posts, I was just thinking to myself that it will involve a lot of work to collect the checks, keep a record (even non-profits must maintain it for IRS I suppose) and deposit it. Most people in IV now are working professionals with a day job. The current system of electronic payment is best for now, in my opinion.
