The total number of applications excluding EB2, EB3 are 7,653.
The total visa's per annum -> 140,000
Considering that there would be more applications during the year from non-retrogressed countries/categories ..it is evident now that there won't be more than 5K such applications. On pessimistic side even if we consider 10K such applications, The visas available for retrogressed EB2 and EB3 should be around 120K this year.
Total pending EB2 is 74,932. So EB2 should be Current for all countries this year.
EB3 should get around 40K visas this year.
Any one disagrees?
I thought each EB category could get upto 28.6% of 140000 = 40000 visas every fiscal year. So if EB1 uses up 5000 and EB2 takes the remaining 35000 and its annual allotment of 40000, EB3 does not get any spillover.
Thoughts?

I am a big supporter of Obama and a big fan and am eagerly looking forward to see him as our next President of United States. As a legal highly skilled immigrant what can I expect? Well, not sure if I would see myself living here anymore. I have been in the green card queue for more than 8 years now and still waiting. Will Obama's administration do anything for people like me to help reduce backlog? I doubt such a thing will ever happen. I would see myself and people like me discouraged and start packing our bags and move on with life.
Why do I feel discouraged? If anything is going to happen for the immigrant community when Sen. Obama becomes the President, it is going to be in the lines of CIR 2007. There would be provisions to make illegal immigrants as legal and remove backlogs to family based quota whereas posing harsh restrictions on H1b visas and reducing Green Card quotas and scrap AC21 portability and try to experiment with some new kind of skilled immigration system.
The above is very evident based on the fact that Senator Durbin has been very hostile to EB immigrants. I am afraid that Senator Durbin will make the calls when Senator Obama becomes the president.
Please post your opinions. This is a very important discussion. It is very important that the community see what is in store for us when the new Administration takes charge.
A lot of folks in the EB community are looking forward to 2009 thinking something will definitely happen. Yes, something will definitely happen - and that may not help us

I don't think the madness will end anysoon, as Lou "Liar" Dobbs show is providing execellent TRP to CNN. And advertisers will put their money in shows that provide maximum coverage. Forget Dobbs, there are so many copy-cat imitators in all sorts of media - including print media - who have began imitating BALANT LIES tactics of Lou. Expect the situation to get worser and worser, with every passing day, as LIAR Dobbs is easily left off without facing any damages for his 'Libelous' and 'Defamatory' actions
Only way to stop this madness is to make the lies - COST THEM FINANCIALLY - CNN and Lou Dobbs in particular. This can be made only by filing a Class Action Libel and/or Defamation lawsuit(s) against CNN and Lou Dobbs.
Question is who'll bell the Doggs?

Everything coming out of USCIS is a "I-797 Notice of Approval" :) and AP is no exception.
I am far from getting one myself but have seen colleague's approvals - this is printed on the same form like the H1 approval. Whether you subsequently need a stamp on the passport I don't know.
Hey Guys,
Can you please tell me in what form you get your advance parole (AP)? Is it like a Visa stamp on your passport or is it a temperory card like the EAD?
Thanks
Lasantha

Ease in immigration standards called for
The United Press International, February 8, 2006
http://www.upi.com/NewsTrack/view.php?StoryID=20060208-105741-3392r
Washington (UPI) -- A leader of a semiconductor company wants the United States to ease immigrations standards to make it easier to hire and retain foreign nationals.
Intel Chairman Craig Barrett, appearing on a question-and-answer forum on FT.com, said a market-based approach to granting work visas should replace the current system, which sets numerical limits on such documents.
Several leaders of technology companies have made similar requests of U.S. officials, the Financial Times said Wednesday. The visa classification that allows foreign engineers and scientists to temporarily relocate to the United States has a limit of 65,000. Some 140,000 green cards, allowing permanent stays, are granted each year.
Barrett said the figures are too low, pointing out the work visa total has already been reached this fiscal year.
'These arbitrary caps undercut business' ability to hire and retain the number of highly educated people in the field where we need to maintain our leading position,' Barrett said on FT.com.
Barrett suggested, 'We should just staple a green card to every advanced degree granted to a foreign national from a U.S. university in science and engineering.'

My immigration doctor told me that if i had chickenpox in childhood i do not need the varicella vaccine? Which i did at age 5. Please, let me know if anyone else was told the same , i will be going back to him on Wednesday for the physical exam. I don't want to get a RFE on that.
You need proof that you had chicken pox- a relevant letter or prescription issued at that time. Your Doctor can also order a test to find out the antibodies- the presence of which proves that you had chicken pox, but my Doctor told that it is expensive and easiest thing is to just take a shot. (This is what we did for my Sons school admission here, same provision is applicable for immigration I guess)

Ok guys, I got a bunch of red dots.. what more can you expect from people whose comments are as below...

bitch, wtf "Rolling_Flood"
stop making dumb arguments. if you don't like this thread stay away from it.
you have no clue who gives you reds and greens, don't presume. plenty of people quietly read and can spot out the rubbish. and no one can give two reds in a row, so i'm another person. Glad to see acceptance finally that PhDs are being disadvantaged
****************************
1. Rolling_Flood, with this temper I am sure you are going to piss off your lawyer with whom you would be working (if at all you do..) on getting portability removed.
2. if you don't like this thread stay away from it. Lots of people disagree, that does not mean that only people who agree with you can post here. Also, how will I know if I am going to like the thread or not without visiting it?.
NKR Dude,
I give you a green.
Some guys dont have the guts to come out openly in the forum to accuse us because they know that they will be banned by moderators. They just give us red dots and call us all sorts of names like moron and ....... in private.
Everybody has the right to disapprove a post but they have no right to use bad language.
Hope these guys understand this is a forum for good cause and they are misusing it.
Thanks

Pls explain how your stmt can be true. IF a person does not have a transit visa how does one clear immigration...hmmmmm. TV is just another way to make money for transiting thru the country. The sad part is we don't even get to move between terminals to proceed to the next flight. Agreed one has to do some due diligence before traveling but people do make mistakes. No one is arguing abt the TV but for the process and difficulty in obtaining one. Enough said.
It really is amazing how much hot air has been generated on this thread over a well established transit visa requirement.
The reason transit visas are required in the UK is that many passengers with an intention to transit the UK have stayed. The transit visa was introduced as a way of making sure (as much as possible) that the passenger has the intention and the ability to transit the UK and to enter a third country.
The list of nationals that are required to have a visa to transit the UK represents a list of countries where there has been a particular problem with over stayers. It is not race based, but merely an effort to target the problem.
It really does not matter what anyone thinks about the transit visa requirement because it is UK law. Everyone has a choice whether or not to transit the UK. Going back to the original post, to book a ticket without researching visa requirements and then trying to deflect personal responsibility by blaming the visa requirement is ridiculous.

I concluded the same ( Though never posted that analysis :)) But It looks like we are missing a very critical point - we are assuming that " these pending numbers are the total 485 workload USCIS has" but I referred a different chart on USCIS board and it looks like there is a separte hoard of "preadjudicated" applications already sitting in a queue apart from these numbers. Please check on following link.
USCIS: National Processing Volumes and Trends (http://dashboard.uscis.gov/index.cfm?formtype=9&office=4&charttype=1)
The I-485 information in this chart includes the family based I-485s as well.

He just introduced an immigration policy called OVERDUE and it would severely restrict legal employment based immigration..
The legislation would end immigration of extended family members of U.S. citizens and permanent residents, which has long been the basis of legal immigration. The bill would shrink to 5,200 a year the number of visas issued to foreign workers.
