Guess What from NOV - 08 to July 09, the VB will have older Cut off dates and after July 09 DOS will open the flood gate and move the cutoff of to 2007 or even 2008.

I couldn�t apply in July and applied to August, as if that RD was not enough, they moved my case from TSC to NSC and reset the RD to Oct. Not only are they not following PDs, they are throwing away RDs according to their whims and fancies� I have lost faith in the system.

Hi,
I have my I-140 (approved in May 07) approved from my previous employer. I am not sure whether he has revoked it or not. I am now working as full time employee with another company. How can i find out if my I-140 was revoked or not? I am yet to file a New PERM, i already got a PERM denial after joining this new employer :( looks like i have to file one more... This looks like a infinte loop :(

Ladies & Gentlemen
I can understand the emotion and commotion among my fellow beings who are stuck with BECs. I waited agonizing 5 years to get my labor cleared. We all clearly understand what are you guys going through.
But the thing is that Labor Certification issues are taken care with PERM implementation. Also the administration set up 2 BECs to take care of them back logs. Now the issue is purely administrative and not law making. Also BECs made it clear that by Oct 2007 all the back logs will be cleared.
Right now big things are happening in the immigration law making. So I think we should concentrate to get the best out of it and achieve our goals on the Green Card Visa issues. As Tom Tancredo is going to fight with teeth and nail against Immi Bills, we have to do the same.
There are many others issues we can lobby for such as
1) Starting H1B stamping inside the US again( Which was stopped in 2005)
2) Allow H1B spouses to work. etc etc
But I believe our priority for the time being should be Retrogression. I request all of you to use this thread for finding a person to testify.

If indeed the majority at IV believe that BEC is not a problem, then it would not be a stated goal of IV. Let me repeat, so long as it is listed as a goal, it is the moral responsibility of all of to support and work towards resolving the issue.

I've had both kinds of accounts for years
NRE - you can only deposit funds from abroad, but cannot deposit funds into it from India. Havent repatriated back - so not so sure abt those rules
NRO - you can deposit funds from abroad & any money you receive in India - eg. if u get rent, or your PPF money etc. Bank will also deduct TDS on the interest you earn in this account. Not so with NRE. Legally, when you leave India, if you do not close your accounts, you shd change the status of ur existing a/c to NRO.
As far as the issue being faced by OP - dont know how much money we're talking abt here, but if your folks send u thru legal channels, they will have to explain why the money is being sent.

my labor has to be pending 365 days or have an 140 approved to extend. so if pp goes away for 140 then my only option to stay in status is EAD. Also I am not in IT so patni,tcs etc...is out of question.
If you had a approved 140, you'd get 3-year extensions. If it is pending, you could still get 1 year extension.
While I'm sure about this rule, you should check with the attorney.

I do not believe original employer was involved in any Fraud but he did have financial trouble ( paying salary after 2 months , check bounce etc - that is the main reason I left) .
That company is MSU software based in Iowa ( just in case if anyone knows about it ) .
I tried several times approaching USCIS as well as Congressman's office to find the details of delay / extended review status etc but all I got was we need to wait until the review is complete.
I had switched attorney as soon as I joined company B and they AC21 and I have copy of the all the docs including the letter requesting to remove the old company A attorney . Also last my company B changed the attorney firm to a different one and they did sent a new G28 for that .
I am kind of stressed until I see the letter which is going to be delayed because of the snow Storm :( .
I have sent the email to info@immigrationvoice.com just now.

AND I saw it while she was fiddling with my file at the interview. Sometimes, it's just sheer back luck. So if you know you have everything you should have in your file, just chill. It's another bump in the road and it'll mean more waiting for you, but it's not the end of the world.

I do not know what level of education you have achieved so far in your life but it looks like you are not enough educated to differentiate between the definitions of permanent residency, citizenship and perhaps working on work visa as far as legal stay in USA by outsider is concerned.
What would be the "legal" reply from US Supreme court,if you ask US supreme court that whether citizen of other country can call US president a "My president"? . And What would be the "legal" reply from Supreme court of country A,if you ask that whether citizen of country A can call US president a "his/her president"?

And what is expected legally is one is not involved in "Anti USA" activity whatsoever it may be.USA legally never expects citizen of other country "to love" or "show fidelity" towards USA when s/he is still the citizen of other country.

It still does not expect "fidelity" towards USA in legal sense.There is no legal or social or political or any kind of pressure from USA or any governmental or non governmental institutes within USA on any particular person coming from other country to become its citizen. Its very interesting to read about people�s different perspective about same thing we are all after.. lets ask ourselves.. honestly why we do want GC and I am sure we all would have multiple reasons for this in our subconscious but would not like to bring it to forefront because it would only undermine our own ability to fight it or make life more stressful.. but end of the day we all want this card.. for me I want it mainly for security and peace of mind�lets look at the different situations.. these might be extreme but we all might have thought about these situations atleast at some point in the recent past� .. and especially the people in the seventh year
1. You are in your seventh year� and you loose you job�.what is the first thought that comes to your mind.. I got to pack and leave .. pack your home of seven years and all your possessions you collected, in two suitcases of 50lbs each and leave�forget the Flat Screen TV,, forget all the electronics and the two cars you love ... just list them in craigslist �
2. You have home which you bought with so much pride�what do you do? ..List it.. make a desperate sale in this falling market.. loose a ton of money and leave�and don't even talk about all the silk plants..floor lamps.. the furnishing,, they are for the yard sale on the Saturday..
3. 3. Seven years in US.. you have made your professional contacts.. and have a social network.. in which you invested your time and effort.. loose your job in the seventh year.. and all these contacts are nothing but an occasional international long distance call in future..
Last but not the least� flight back home to your country is not going to be as smooth as the flight to US was seven years back.. back home look for a job..learn the whole new professional culture �and then set up a new home,,new school for kids�.why because we could not get a GC.. which was not in our control.. and because some stupid insane guy sitting in cave 10K miles away decided to terrorize the people in America in 2001.. and make life difficult for all the people..including people in H1...
We might all go back to our home country one day.. but the ride back home would be much more pleasant and happier of a choice we made and not because we did not get a GC�

First and foremost, if you lose a job, it doesn't matter what your immigration status, life is going to become difficult for you and your dependents.
I lost my job in the 7th year of H1 but since I had well researched and planned for that scenerio before entering into the 7th year, I am still here in a new job with an anticipated 3 year extension from 2007-2010.
If a lobor from your previous job has been pending for more than 365 days, you are able to port the benefit of the 7+ year extensions to the new job. This will let you survive the 7th year job loss.
Likewise there is a "best possible" solution to all the hardships that you have listed above and that "best possible" solution will vary from person to person and hardship to hardship.
Life takes planning, no matter what your immigration status.
My friend who is an EB GC holder just sold his house and took a $40000 loss. Bad planning on his part. Purchased the house at the wrong time and sold it at the wrong time too.
Since he sold his house, he is forced to move and so his kids schooling is distrubed too.
Its been 3 months he has moved to his apartment and his other half doesn't like the apartment lifestyle after having lived in a house for a year.
Did his GC help in all this???
Compare that to me, I am not a GC holder.
I am sitting on $240,000 equity in my house for which I have no plans to sell.
I too was forced to move due to a recent 7th year H1 job loss, and miss my boating trips to the lake near my old house. My new job is a 100 miles away from my house so I decided to do weekend commutes to the old house, and still manage to hit the lake every weekend.
My better half also didn't want to move in an apartment due to my new job. Good enough, we leveraged the equity in our 1st house & higher income from the new job to buy a 2nd house near the new job site.
Did my not having the GC hurt???
GC or H1 didn't matter, good planning is what has helped me, and bad planning is what doomed my friend...
1. You are in your seventh year� and you loose you job�.what is the first thought that comes to your mind.. I got to pack and leave .. pack your home of seven years and all your possessions you collected, in two suitcases of 50lbs each and leave�forget the Flat Screen TV,, forget all the electronics and the two cars you love ... just list them in craigslist �
2. You have home which you bought with so much pride�what do you do? ..List it.. make a desperate sale in this falling market.. loose a ton of money and leave�and don't even talk about all the silk plants..floor lamps.. the furnishing,, they are for the yard sale on the Saturday..

You have child whom you love and have plans for them.. love the school.. are an active member in the PTA � all of sudden what you do.. pull them out of school, move them from the only culture and the country they have known the only President they know is Bush and the only national anthem they have learnt is "The Star-Spangled Banner"�to another place where they don�t even understand the language forget the culture, national anthem etc..
4. Think about your spouse.. they have adopted themselves to this lifestyle.. probably felt lonely when you moved here 7 years but now like it.. its time for them to move back�why because your don�t have a GC
5. Forget the Golf and Tennis you enjoy so much here �it was all a very good dream..

10000 more homes is nothing. This is not INDIA. The economy is so huge that 10000 homes is a drop in the ocean. And is the Govt. going to believe that all 10000 immigrants are going to buy homes? 75% of them won't qualify for new mortgage rules.
Plus, what is stopping you from buying a home right now?
