    Intresting someone brought up Gandhi's name here, we just'nt could manage more than few hundred to get togather to raise one voice, I just wonder if I think how this person was able to inspire millions to march on street and follow him without any questions asked.

    Gandhi was a great man no questions, he had the all the intellectual, personal and spiritual qualities required to lead the nation. With those qualities alone, he could not have convenced more than half a dozen people. The nation at that time was in need of a leader like him. When they found the right man, the followed without questions.

    It will bring down the workload? Can you explain how? If anyone in the world is eligible to apply for the GC without sponsorship, the system will be flooded with applications, irrespective of whether they carry any merit or not. What makes you think that an organization that cannot process 140K applications per year can handle millions?

    The point based system sounds great in theory, but cannot be implemented efficiently by the U.S. as long as it remains the most desired country for immigrants. It works for Canada, Australia and the U.K. because fewer people want to move there.

    Anybody wont be eligible. Canada has been fine tuning the immigration since 2002.
    Now only people who have studied or worked in Canada on work permit are eligible.
    family based is greatly restricted unlike US where around 80 is non-skill based.
    If they want they always reform but the exiting H1B is so good for American Companies that they will fight to keep the existing H1B-GC servitude instead of
    any point based..

    Plus there is politics of vote bank: Moment the CIR comes, the sheer stampede of illegal lobby like the bulls of Spain, H1B folks get crushed. Last time, moment the CIR came, H1B people started opposing it because it literally made illegals ahead in line line with more points in the point based system.

    That's why I am skeptical of CIR as of now. H1bs don't have much chance in front
    of the madness of illegal lobby vote bank. Based on my observations of how the
    US politics works I don't see promise in CIR (one of main reasons I left for Canada)

    Not to mention, a lot of antis are not that against EB reform but moment CIR comes
    all anti-s get united in opposition. The illegal bobby hold H1Bs as hostage unless they get what they want. It is such a deadlock that I just don't see how it can be fixed.
    Unless there is another super powerful lobby helping us like US industry (supreme powerful lord in US politics) which currently wants the existing H1B system I don't see headway.



    PS: In 2002 Canada passed IRPA where they delegated the rule decision making to the executive branch unlike US where any change has to be legislated.

    One big missing piece in your analysis - Country quota.

    As per your analysis, there are around 125K pending cases. If there is no spill over (that is the case this year and that will be the case for the coming years as per State dept.), then EB3-I or EB2-I gets only 2700 visas per year.

    Now, please redo your math and you can easily see that the current retrogress might look like there is hardly any retrogression.

    country quota will not impact I and C once the dates are current for ROW due to the spillover. If the number of applications pending is, say 100K and 95 K out of that are I and C. And assume 10K applications from ROW are add to the queue, what I am saying is all 110K will be cleared by end of the fiscal year.

    My EAD is set to expire Oct 8th 2008.
    So I applied for renewal on Jun 16th via USPS express overnight mail to Texas.
    I live in Pennsylvania so had to post it to TEXAS.
    USCIS already cashed the check and sent me a receipt notice!
    Seriously that was ultra fast.

    Since they recently announced about 2 year EADs which will be issued from Jun 30 onwards, I am concerned that the fact that they cashed the check so fast, do you think they will also give me a EAD fast, that too before Jun 30th ? If they do will that be valid for one year or 2 years? If they wait for issuing, and if that happens after Jun 30, will that be a 2 year or a 1 year one?

    I have an nre repatriable demat acct thru icici - it took all of 5 mnths and over 30 calls to cust svc to get the acct opened. The acct was mainly for utilizing the indian stock opts given by employer. You can trade as an NRI but online trading is not available for US residents on nre demat accts - u can however trade thru a broker like sharekhan etc.

    All dividends are credited only to your NRE savings a/c - not to regular savings a/c. Any stock sale requires an authorization number which the broker can provide. Taxes on capital gains must be paid only if you sell within a year of purchase - the percentage is the same as for Indian citizens. There is no tax on long term cap gains

    Since we do not have any taxable income in India, and many NRIs make charitable contributions regularly, the tax liabilities are usually not very high

    Also there is a very informative section on sify.com for NRI taxation. You are not required to file any tax returns if you are in NRI status and are within the exemption limits.

    What was really pathetic - dependents of L1 visa holders were allowed to work, whereas dependents of H1 visas - the H4s, were not!

    All they're left to do - if they don't qualify or have any interest in a high-tech field - is to listen to frustrations of their H1-holder spouses about this whole immigration mess!

    I totally agree with Arunmohan- We H4's are not considered basic human beings here, we are not allowed to work ,may of us experience difficulty in getting a drivers license, we cannot have an independent bank account- literally we are considered as without life. I do wish I came in here illegally, at least i see hope for illegals in these bills - what do H4 Visa holders have to wait for !!!

    I agree .. again :) .. that companies may not be too excited about the employees taking off for a few hours.

    Can't we have something potent:
    Say we have a page on IV that lists all the members with names, GC applied on, wait time to date, company working for. Accompanied by any info that makes this look authentic like SRC number .. or something (need not be displayed, but can be in database).

    We could then get some graphs and statistics based on these figures and pass it on to lawmakers, other people who need to be influenced.
    This way we have all teh facts .. rather than arbitrary data like:
    "Today the system takes anywhere between 6-12 years to grant Green cards to some of the best and brightest of the world who have chosen America as their future home."

    To the best of my knowledge they make good money. I personally know so many examples where H-1s make more money than US citizens. Only exception would be the ones who are fulltime in Infosys type companies.

    I understand and agree with all the points except I am not sure how it puts ppl with pending 140 at risk. Can you please elaborate?

    Also, AC 21 repealed? So no switching of jobs after 6 months of 485? What about those who have already switched?

    Also, the current visa numbers are 9800 for a country annually. That limit goes down to 9000. Its a 10% cut but is that going to have major impact on retrogression?

    I and many folks in this forum have seen very few approvals for this category. How come USCIS says that this category is over subscribing the visa quota. Why they are moving un used visas to EB2 (no offense) why not for EB3?

    We need IV help in this area.

    This now will give me a 2 year EAD. and even after 2 years If I dont get a GC, I will be able to reapply for EAD, at that time WITHOUT any FEES!!


    Not true! You will have to pay $340 or whatever the fee is at the time you renew your EAD again.

    not personal, addressing many issues.

    1. if your company pays for everything, why such reluctance to put up a few more dollars for your own cause? think of those that pay for everything themselves and still contribute.

    2. each contribution to paypal costs, they take a chunk off it. making small 10 buck contribution is really not the intelligent way to go.

    3. there used to be a 20/mnth recurring contribution. now it does no exist. what do you want? should we throw out the original 20 buck guys? of course they can continue doing it. i can't imagine why it would put you off? btw we did not really lose any money by going to a minimum of 50- you know why? those who were serious still contributed. others who were whining at that time (why is there not a 10/mnth option) were in many (though not all) cases not going to contribute anyway. this is just fyi.

    4. what is 50 bucks a month? step back and think sometime. a family meal/movie? do you indulge yourself occasionally worth 50 bucks?
    i think in many cases the answer is yes. the money we need for lobbying ie very large....it's hard to make it form 20 bucks at a time when barely 5% of the membership contributes.
    you have the choice hereof donating 100 now and considering it as two 50 buck donations, so your next one will be delayed. there are various ways of looking at this.


    there are various ways to contribute, money is just one of them- although very important. if you have not done this, join a state chapter and start meeting lawmakers in your area. get friends to join iv. put up fliers and posters in local grocery stores/fairs and festivals etc. there are many good examples of these activities being done successfully. in the end it's going to matter is whether we put enough effort to push over the line- whether it's today or in 2 years.

    we all have a choice. please make a wise one.

    You've hit the nail right on the head, buddy!

    4) Be positive in your attitude, improve your communication skills and dont act servile.
    5) Most desis are hard working and responsible people - nothing should hold them back - not certainly the need for an image makeover.

    All fellow desis take care and enjoy your life here - life is too short to be depressed about the green card everyday. Most important thing is you stay happy everyday - here or in India.
